Laws and Regulations.
Which websites and online shops are required to provide plain language – an overview. This overview is not a substitute for legal advice.
EU Directive 2016/2102 on accessible websites for public sector bodies has been in force since 2016. In Germany, the BITV 2.0 implements this directive for federal institutions. At the very least, the home page and the accessibility statement must be available in plain language.
For institutions run by the federal states, accessibility and the requirements for plain language are governed by the respective state equality acts. Each federal state implements the EU Directive in its own way.
Local authorities such as municipalities, the federal states and the federal government; professional bodies and institutions such as chambers and universities; and bodies governed by public law. In addition, associations that are predominantly funded by the federal government or in which the federal government holds a majority stake.
The Accessibility Enhancement Act (BFSG) has been in force since 28 June 2025. It applies to manufacturers, retailers and importers of certain products, as well as providers of services, including e-commerce such as online shops, banking services and e-books.
Micro-enterprises with fewer than ten employees and an annual turnover of no more than €2 million that provide services are exempt. However, if they place products on the market, they fall within the scope of the BFSG.
